APPLICANT REQUESTS THAT:

His DD Form 214, Certificate of Release or Discharge from Active 
Duty, section 18, Remarks, reflect that he entered the Air Force 
in the Delayed Enlistment Program (DEP) in May 75.

APPLICANT CONTENDS THAT:

This date would entitle him to more Department of Veterans (DVA) 
benefits. 

In support of his appeal, the applicant provides copies of his 
DD Form 214 and DD Forms 4, Enlistment Contract-Armed Forces of 
the United States. 

The applicant's complete submission, with attachments, is at 
Exhibit A.

STATEMENT OF FACTS:

On 5 May 75, the applicant entered the DEP.  He was credited 
with 3 months and 17 days of total prior inactive service.

On 22 Aug 75, the applicant enlisted in the Regular Air Force. 
He was credited with five years and nine months of total active 
service.

AIR FORCE EVALUATION:

AFPC/DPSOR recommends denial. Governing DD Form 214 directives 
and policies do not authorize a DEP statement on the 214.  DoDI 
1336.01, Certificate of Release or Discharge from Active Duty 
(DD Form 214/215 Series), states the intent of the DD Form 
214 is to “provide the Military Services with an authoritative 
source of personnel information for administrative purposes, and 
for making enlistment or reenlistment eligibility 
determinations.”  The information on the DD Form 214 is a 
snapshot of time for a period it was published and not subject 
to change so to meet evolving wants, needs or data 
interpretations by individuals or agencies.    

The applicant’s participation in the DEP is accurately reflected 
in block 12e, Total Prior Inactive Service (22 Aug 75 minus 
3 months and 17 days equals 5 May 75).  

The applicant failed to provide any evidence the document was 
published in error.

APPLICANT’S REVIEW OF THE AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the 
applicant on 10 Jan 14, for review and comment within 30 days 
(Exhibit D).  As of this date, this office has not received a 
response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been presented to 
demonstrate the existence of an error.  We took notice of the 
applicant’s complete submission in judging the merits of the 
case; however, we agree with the opinion and recommendation of 
the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion the applicant has not 
been the victim of an error or injustice.  In view of the above 
and in the absence of evidence to the contrary, we find no basis 
to recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
